Direct booking terms for Santa Clara & La Roca

1. Scope

These Terms & Conditions apply to direct reservations made through the Santa Clara & La Roca Booking Website for our tourist accommodation in Torremolinos, Málaga.

By completing a reservation, the guest confirms that they have read and accepted these Terms & Conditions together with the specific price, payment terms, cancellation policy and house rules shown during the booking process.

2. Booking confirmation

A reservation becomes confirmed when the booking process has been successfully completed and a booking confirmation has been issued.

The confirmation will identify the accommodation, dates, number of guests, total price and the applicable booking conditions.

3. Prices and payments

The total price, applicable fees, payment schedule and payment method are shown before the reservation is confirmed.

Payments are processed through the booking platform and the connected payment service provider.

Any amount due must be paid in accordance with the payment schedule shown during booking.

4. Cancellation policy

The cancellation conditions applicable to the reservation are displayed before booking and are included in the booking confirmation.

Those specific cancellation conditions form part of the accommodation contract.

Accommodation booked for specific dates is not subject to the general 14-day consumer withdrawal right applicable to many distance contracts. Spanish consumer law expressly excludes accommodation services supplied for a specific date or period from that withdrawal right. BOE

5. Check-in and check-out

Check-in and check-out times are specified for each apartment in the booking confirmation and guest information.

Early arrival or late departure is subject to prior agreement and availability.

6. Guest registration

All guests must provide the information legally required for traveller registration before or during check-in, as applicable.

Spanish law requires accommodation providers to collect and report specified traveller and stay information. BOE

Guests must provide accurate information and cooperate with the registration procedure.

7. Number of guests

The number of persons staying in the accommodation must not exceed the maximum occupancy shown for the apartment.

All overnight guests must be included in the reservation and registration process.

8. House rules

Guests must respect the accommodation, common areas and applicable community rules.

Quiet hours are:

23:00–08:00

Guests must avoid excessive noise, nuisance or behaviour that may disturb neighbours or other users of the building.

Andalusian rules require tourist-accommodation operators to inform guests about community rules, restricted areas, use of facilities, pets, smoking restrictions and local noise requirements. Junta de Andalucía

Serious or repeated breaches of house rules may result in termination of the stay in accordance with applicable law.

9. Pets

Pets are permitted where indicated for the selected apartment.

A €30 pet fee per stay applies and covers the additional cleaning required after a stay with a pet.

Guests remain responsible for any damage caused by their pet.

10. Care of the accommodation and damage

Guests are expected to use the apartment, furniture, equipment and common areas with reasonable care.

Guests may be responsible for damage caused intentionally or through negligence beyond normal wear and tear, subject to applicable law and appropriate evidence.

Any damage or malfunction should be reported as soon as reasonably possible.

11. Facilities and seasonal services

Certain facilities, including swimming pools, restaurants, lifts, parking or other shared services, may be seasonal, subject to opening hours, weather conditions, maintenance, community decisions or availability.

Where parking is offered subject to availability, it cannot be guaranteed unless expressly confirmed.

12. Service interruptions and force majeure

We will make reasonable efforts to provide the accommodation and services as described.

We are not responsible for interruptions caused by circumstances outside our reasonable control, such as utility outages, severe weather, public restrictions or failures affecting shared building facilities, without prejudice to any mandatory consumer rights.

13. Complaints

Official Andalusian Complaints and Claims Forms are available to guests in accordance with applicable regulations.

Tourist accommodation operators in Andalucía are required to keep official complaint forms available and display the corresponding notice. Junta de Andalucía

Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.

15. Booking platform

The Booking Website is technically provided using Hostaway.

Hostaway provides the booking infrastructure but the accommodation contract is concluded with the accommodation operator identified in the booking confirmation.

16. Governing law

These Terms & Conditions are governed by Spanish law.

Nothing in these Terms limits any mandatory rights that guests may have as consumers under applicable Spanish or European law.
